EU Court Transfers PPD–Gazprom Dispute to Croatian Jurisdiction

The legal landscape surrounding energy supply agreements in Southeast Europe has shifted significantly following a recent ruling by the Court of Justice of the European Union. The court has declined jurisdiction over a dispute between Croatian gas supplier Prvo Plinarsko Društvo (PPD) and Gazprom Export, which is now set to be resolved within the Croatian judicial system. This case, involving claims valued at approximately 35 million euros, underscores the complexities of international energy contracts and their enforcement.

The origins of this dispute trace back to a gas supply agreement established in 2017, which was designed to last for a decade and included multiple amendments. However, tensions escalated in 2022 when Gazprom Export unilaterally altered payment terms, requiring transactions to be conducted exclusively in rubles. This change deviated from the original contractual stipulations and has been a focal point of contention between the parties.

The ruling indicates that all involved parties, including financial entities such as Privredna Banka Zagreb (PBZ), will pursue their claims through national courts in Croatia. This transition to domestic legal proceedings may have significant implications for the enforcement of energy contracts in the region, particularly as it pertains to compliance with evolving geopolitical directives.

The unresolved nature of this dispute highlights broader challenges within the energy sector, where shifts in regulatory frameworks and payment structures can lead to prolonged legal battles. As the case unfolds in Croatia, stakeholders will be closely monitoring its impact on future gas supply negotiations and regional energy security.
