Challenge to natural gas transportation charges
Energoinvest, a Sarajevo-based gas importer, plans to take a dispute over natural gas transportation charges to the Supreme Court of the Republic of Srpska. The company said it will challenge a ruling on how regulated network tariffs should be applied. Energoinvest argued that the case could influence the wider application of regulated network tariffs across Bosnia and Herzegovina.
The importer said transport charges should remain within the tariff framework approved by the competent regulator. It warned that allowing network users to be billed at different rates could weaken legal certainty and undermine the regulatory system.
Second-instance decision and next legal steps
The move follows a second-instance judgment by the Higher Commercial Court of the Republic of Srpska. Subsequent public statements were made by Sarajevo-Gas Istocno Sarajevo, according to Energoinvest’s account of events.
Energoinvest said it reviewed the second-instance ruling and intends to seek a revision within the statutory deadline. The company added that the decision did not exhaust the legal remedies available to it .
Consistency of transportation fees across gas network users
The dispute also raises whether transportation fees are being applied consistently to every company using the gas network. Energoinvest’s position links the tariff application question to how approved tariffs must be implemented in practice.
Energoinvest said that Supreme Court proceedings could have consequences beyond the immediate financial claims of the two companies involved in the dispute. A decision clarifying how approved tariffs must be applied would affect predictability of gas transport costs and contractual relations across Bosnia’s fragmented gas market .
