Greece’s top administrative court voids approvals for 185 MW solar project

Council of State cancels licences and work approvals

Greece’s highest administrative court has struck down approvals for a 185 MW solar development that had been divided into scores of smaller projects. The Council of State cancelled 186 preliminary producer licences and 25 work approvals linked to the project near Pineios Lake. The ruling applies to the approvals granted for the development’s permitting pathway.

Common ownership and functional integration under scrutiny

The court said authorities failed to assess whether the installations, although presented as separate, effectively amounted to one investment under common ownership. It targeted a permitting approach that can allow large developments to be split into sub-1 MW units. Under that model, projects may be eligible for simplified permitting treatment.

Potential impact on clustered solar structures and battery pairings

The decision is not limited to the Pineios Lake site. Developers using clustered structures may face more comprehensive environmental and planning review if common ownership, location and technical design indicate the assets operate as a single development. The ruling could also affect projects paired with batteries where generation and storage have been organised through multiple special-purpose companies.
