After the public hearing, Croatian energy market regulator HERA published the Instructions for the Implementation of the Decree on the Law on emergency intervention to solve the issue of high electricity prices.
The instructions clarify the obligations of those liable to pay excess market income. This is primarily related to producers who are required to obtain a permit for the production of electricity and who are delivering electricity to the network. Traders, the transmission system operator, the distribution system operator, the energy market operator and the CROPEX exchange are also liable.
Thus, producers must submit concluded sales and purchase contracts with agreed delivery for the previous month. They should inform about realized prices and quantities, such as sales on the exchange, and the calculation of excess market revenues above the level of 180 euros/MWh for the previous month. Producers with contracts that deviate from the long-term agreed prices on HUDEX should provide justification for such deviations.
Those subject to this regulation should submit data for December 2022 at the beginning of February. The funds collected this way is the income of the Environmental Protection and Energy Efficiency Fund and should be used to encourage the installation of solar power plants.
