The resolution of a significant financial dispute between the coalmine and thermal power plant RiTE Ugljevik and Elektrogospodarstvo Slovenije (EGS) marks a pivotal moment in the regional energy sector. The newly signed agreement, valued at approximately 37 million euros, effectively concludes a complex case that has lingered for several years, addressing all outstanding obligations between the two entities.
This settlement not only brings closure to the financial disagreements but also allows both parties to withdraw from a potential arbitration process in Washington, which posed a considerable financial risk. The dispute had the potential to escalate into claims nearing 650 million euros, but through negotiations, they have successfully avoided prolonged legal complications.
The roots of this dispute trace back to previous rulings that mandated RiTE Ugljevik to compensate EGS for undelivered electricity spanning from 2011 to early 2022. This agreement also stipulates that a portion of the plant’s ongoing electricity production will continue to be supplied to the Slovenian partner, ensuring operational continuity and compliance with prior commitments.
While most of the principal debt and compensation had been addressed in earlier agreements, unresolved issues regarding accrued interest remained a sticking point. The recent settlement resolves this component as well, including a reduction in the initially claimed amount, thereby allowing both parties to finalize their dealings comprehensively.
A payment plan is already in progress, with initial payments being processed. Concurrently, electricity deliveries to EGS have resumed since early 2024, aligning with previous commitments. The agreement is further secured by the parent utility company, which provides an added layer of stability and enforcement for both parties involved.
